In WY, won a civil lawsuit. I heard that with that the debtor's tax returned can be garnished, Is this true and how do I get it done.Is it true that the IRS can collect civil lawsuit judgements for the Creditor?
The collections procedures for a civil judgment vary from state to state. The IRS, however, generally will not honor a civil judgment unless that judgment is for child support or for a federally guaranteed student loan. In those cases, the tax refund can be intercepted. (Its technically not a garnishment).
I suggest you consult an attorney there in Wyoming to determine the best method of collecting. Wage garnishments, garnishment of bank accounts, and siezure of other assets *MAY* be possible. If he gets a STATE tax refund, you can garnish it, yes. (There's a link to the required form below)
You can't garnish his Federal return. If you find out where he banks, you can garnish that account, hopefully after the check hits the account.
